These Terms & Conditions regulate the use of the IncBuilder platform by all users, including clients (“Homeowners”) and independent professionals (“Tradespeople”).

By accessing or using IncBuilder, the user confirms that they have read, understood and agreed to these Terms, as well as the Privacy Policy and any specific agreements applicable to their user profile.

If the user does not agree with these Terms, they must not use the platform.

 

1. Company Information

2. Nature of the Platform

IncBuilder is a digital platform that facilitates connections between clients and independent professionals.

IncBuilder:

• does not perform services;

• does not provide technical services;

• does not intermediate payments;

• does not participate in service contracts made between users.

Its role is limited to organising access, visibility, reputation and communication between users.

 

3. Eligibility and Acceptable Use

Users confirm that they are at least 18 years old and have the legal capacity to enter into binding contracts.

Users agree to:

• provide accurate and truthful information;

• use the platform only for lawful purposes;

• respect third-party rights;

• refrain from fraudulent or abusive activities.

IncBuilder reserves the right to restrict, suspend or terminate access in case of misuse or breach of these Terms.

 

4. User Profiles

IncBuilder operates with two primary user profiles:

• Homeowners (end clients);

• Tradespeople (independent professionals).

Each user profile may have additional agreements, which complement and form part of these Terms.

 

5. Prices, Plans and Promotional Conditions

Prices, subscription plans and commercial conditions applicable to the use of the IncBuilder platform are defined in specific documents, including but not limited to the Pricing document applicable to each user profile.

IncBuilder may, at its discretion, offer promotional conditions, temporary benefits or price freezes for a defined period. Such conditions apply exclusively for the expressly stated duration and do not create any vested right to maintain the same conditions after the stated period expires.

For tradespeople, where expressly stated in the applicable Pricing document, the subscription fee may be fixed for a defined period starting from the activation date of the subscription. After the expiration of such period, IncBuilder may maintain the existing price or introduce new prices or plans, subject to prior notice.

 

6. Limitation of Liability

To the maximum extent permitted by law, IncBuilder shall not be liable for:

• service execution;

• technical quality of services;

• delays or failures;

• disputes between users;

• indirect, incidental or consequential damages.

IncBuilder does not act as an insurer, arbitrator or guarantor of any services provided by users.

 

7. Intellectual Property

All content, branding, software and visual identity associated with IncBuilder are protected by applicable intellectual property laws.

Users must not copy, modify, reproduce or otherwise use any IncBuilder intellectual property without prior written authorisation.

 

8. User Content

Users are solely responsible for all information, communications, reviews and content submitted or published through the platform.

IncBuilder reserves the right to remove content that violates these Terms or applicable law.

 

9. Suspension and Termination

IncBuilder may suspend or terminate user accounts in case of:

• breach of these Terms;

• fraud or misrepresentation;

• misuse of the platform;

• illegal activities;

• reputational risk to IncBuilder or its users.

Termination does not give rise to any right to compensation.

 

10. Amendments to the Terms

IncBuilder may amend these Terms from time to time.

Continued use of the platform following publication of updated Terms constitutes acceptance of such changes.

 

11. Data Protection

The processing of personal data is governed by IncBuilder’s Privacy Policy and applicable data protection legislation, including the UK GDPR.
