1. Nature of the platform

IncBuilder is a digital platform that facilitates connections between tradespeople and end clients (“Homeowners”).

IncBuilder does not perform services, does not provide technical services, does not intermediate payments and does not participate in service contracts that was made between the tradesperson and the client.

IncBuilder’s role is limited to organising access, visibility, reputation and connections between users.

 

2. Relationship between the Parties

The tradesperson acts independently.

Nothing in this Agreement creates an employment relationship, partnership, agency, representation or franchise between the tradesperson and IncBuilder.

Any service agreement is made  exclusively between the tradesperson and the client.

 

3. Platform access and subscription

Access to the IncBuilder platform is provided through a monthly subscription, in accordance with the conditions set out in the Pricing document.

The tradesperson acknowledges that the subscription is a requirement for access to the IncBuilder ecosystem and does not guarantee a minimum number of requests, revenue or contracts.

 

4. Subscription fee and price freeze

The subscription fee and applicable commercial conditions are set out in the Pricing document in force at the time of subscription.

Where expressly stated in the Pricing document, the subscription fee may be fixed for a defined period. Under the current plan, the subscription fee is fixed for a period of 12 (twelve) months from the date the tradesperson’s subscription is activated.

During this period, the subscription fee will remain unchanged.

After the expiration of the price freeze period, IncBuilder may maintain the current price or introduce new prices or plans, subject to prior notice to the tradesperson.

 

5. Use of the platform

The tradesperson agrees to use the platform in a lawful, ethical manner and in compliance with this Agreement.

The tradesperson must not:

• misuse data;

• manipulate information or reviews;

• present themselves as a representative of IncBuilder;

• use the platform for illegal or fraudulent purposes.

Breach may result in suspension or termination.

 

6. Requests and autonomy

The tradesperson has full autonomy to accept or decline service requests.

The tradesperson has up to 24 (twenty-four) hours to respond to a request submitted through the platform.

Declining requests does not result in penalties.

 

7. Service execution

All services are executed exclusively by the tradesperson, under their sole responsibility.

IncBuilder is not responsible for delays, failures, damages, poor service execution or disputes arising from service provision.

 

8. Payments

Payments are made directly between the tradesperson and the client.

IncBuilder does not process, intermediate or receive payments on behalf of the tradesperson.

 

9. Cancellation

The tradesperson may cancel the subscription at any time, without penalty.

The subscription fee for the current billing period is non-refundable, except where required by applicable law.

Access to the platform remains active until the end of the paid period.

 

10. Suspension and termination

IncBuilder may suspend or terminate the tradesperson’s access in case of fraud, misuse of the platform, breach of this Agreement, conduct incompatible with IncBuilder principles or illegal activities.

Termination does not give rise to compensation.

 

11. Final provisions

This Agreement must be read together with the IncBuilder Terms & Conditions and Pricing.

In case of conflict, the Terms & Conditions shall prevail.
