Homeowners Agreement
This Agreement regulates the use of the IncBuilder platform by clients (“Homeowners”) seeking professional services.
By accessing or using the IncBuilder platform, you confirm that you have read, understood and agreed to be bound by this Agreement - the IncBuilder Terms & Conditions and the Privacy Policy.
If you do not agree, you must not use the platform.
1. Role of IncBuilder
IncBuilder is a digital platform that facilitates connections between clients and independent professionals (“Tradespeople”).
IncBuilder:

does not perform work
-
does not provide technical services
-
does not sell services on behalf of professionals
-
does not participate in service contracts
IncBuilder’s role is limited to organising access, visibility, reputation and communication between users.
2. Nature of the Relationship
All tradespeople registered on the platform are independent professionals or companies.
Nothing in this Agreement creates:
-
employment
-
partnership
-
representation
-
agency
between IncBuilder and any tradesperson.
Any service agreement is made exclusively between the homeowner and the tradesperson.
3. Platform Use
The platform use is free of charge for homeowners.
The homeowner agrees to:

provide accurate information
-
use the platform only for lawful purposes
-
not misuse third-party data
-
not attempt to bypass or manipulate the platform systems
IncBuilder may restrict access in the event of misuse or breach of this Agreement.
4. Requests and Matching Process
When a homeowner submits a request:

IncBuilder validates the information
-
directs the request to compatible tradespeople
Each tradesperson has up to 24 hours to accept or decline the request.
If declined or unanswered:
-
the request will be directed to another compatible tradesperson
IncBuilder does not guarantee that any request will result in a successful engagement.
When a homeowner submits a request:
-
IncBuilder validates the information and directs it to compatible tradespeople.
Each tradesperson has up to 24 hours to accept or decline the request.
If declined or unanswered:
-
the request will be directed to another compatible tradesperson.
5. Freedom of Choice
The homeowner is free to:

accept or reject any tradesperson
-
negotiate directly
-
decide whether or not to proceed
IncBuilder does not impose any obligation to enter into a contract.
6. Pricing, Payments and Execution
Prices, deadlines and payment methods are agreed exclusively between the homeowner and the tradesperson.
IncBuilder:
-
does not collect service payments
-
does not intermediate financial transactions
-
is not responsible for service execution
7. Reviews and Feedback
Homeowners may submit reviews based on real experiences.
The homeowner agrees:

not to post false, abusive or misleading content
-
not to manipulate reputation systems
IncBuilder may remove content that violates platform policy.
8. No Guarantees
IncBuilder does not guarantee:
-
service quality
-
completion
-
timelines
-
pricing
-
outcomes
All services are provided at the sole risk of the contracting parties.
9. Limitation of Liability
To the maximum extent permitted by law, IncBuilder shall not be liable for:
-
losses arising from service execution
-
disputes between users
-
indirect or consequential damages
-
loss of profits or opportunities
Nothing in this Agreement limits liability that cannot legally be excluded under UK law.
10. Data Protection
Personal data is processed in accordance with the IncBuilder Privacy Policy and applicable UK data protection laws.
The homeowner agrees not to misuse any personal data obtained through the platform.
11. Suspension and Termination
IncBuilder may suspend or terminate access in case of:

breach of this Agreement
-
misuse of the platform
-
illegal activities
-
or reputational risk
The homeowner may stop using the platform at any time.
12. Amendments
IncBuilder may amend this Agreement with prior notice.
Continued use of the platform implies acceptance of the updated terms.
13. Governing Law and Jurisdiction
This Agreement is regulated by the laws of England and Wales.
Any disputes shall be subject to the courts of London, United Kingdom.
